About the Firm

Founded on integrity, guided by Syariah principles.

The firm of Amirul Akmal & Associates was established in 2020 with a mission to resolve cases through Consent Agreement, and a vision to resolve every case swiftly and efficiently without prejudicing the rights of clients or any party.

The firm was founded by Syariah Lawyer Mr. Muhammad Amirul Akmal bin Ismail — a First Class Honours graduate in Syariah and Law (LL.B) from Universiti Islam Selangor (UIS), and a holder of the Postgraduate Diploma in Syariah and Legal Practice from Universiti Teknologi MARA (UiTM).

He has practised as a Syariah Lawyer since 2020 across the States of Melaka, the Federal Territories, Selangor and Perak, and serves as a member of the Hakam Panel under the Selangor Islamic Religious Council (MAIS).

Divorce & Dissolution of Marriage
Can I file for divorce if my spouse does not consent?
Yes — through a Divorce petition itself, a Fasakh claim, or a Khulu’ (redemption divorce) claim, depending on the grounds for divorce.
I married in Perak but now reside in Selangor. Where should I file my divorce petition?
The divorce petition must be filed in Selangor, your current place of residence.
My husband pronounced divorce at home or over WhatsApp. What is our status?
File an Application to Confirm the Pronouncement of Divorce at the Syariah Court to confirm the status of the marriage.
Maintenance & Child Custody (Hadhanah)
Who has the strongest right to child custody after divorce?
The mother holds the primary right to custody of a young child (mumayyiz). However, this right may be challenged if the mother is proven to have lost her eligibility on moral or welfare grounds under Syariah law and statutory provisions.
Can the father claim child custody?
Yes. It must be proven that the mother has lost her eligibility for custody to the detriment of the child’s welfare. The court’s final decision always prioritises the best interests of the child.
What does a child maintenance claim at court cover?
As set out by Syariah law, child maintenance covers basic needs: food, clothing, shelter, education, and medical care.
How does the court determine the monthly child maintenance amount?
The court assesses the reasonable needs and standard of living of the child, alongside the father’s current financial capacity and monthly income.
Jointly-Acquired Property & Inheritance
Is a homemaker entitled to claim jointly-acquired property?
Yes, she is. The court considers indirect contributions (such as caring for and managing the household), as well as any direct contributions.
Can jointly-acquired property be claimed if the spouse has passed away?
Yes. A claim may be filed against the deceased’s heirs, and must be settled before the remaining estate is distributed by faraid to the heirs.
Syariah Criminal Issues
I have been arrested by a Religious Enforcement Officer (PPA). What is the first step I should take?
Record the officer’s details and the location you are being taken to. Do not make any written confessions or statements without legal advice, and appoint a Syarie Lawyer immediately to handle bail applications and prepare your defense.
Am I legally required to appoint a Syarie Lawyer if I am charged in the Syariah Court for a Syariah criminal offense?
The law allows you to represent and defend yourself. However, appointing a Syarie Lawyer is highly recommended to ensure your rights are protected, court procedures are properly adhered to, and defense arguments are presented technically and professionally to reduce the risk of a heavy sentence.
If I intend to plead guilty, do I still need the services of a Syarie Lawyer?
Yes. A Syarie Lawyer will assist in preparing a Plea of Mitigation (written and oral). Your lawyer will present justifiable grounds to the Judge in accordance with statutory provisions to plea for the minimum possible sentence, such as a lower fine without jail time.
Will a Syariah criminal record affect my future or my employment status?
Convictions for certain Syariah criminal offenses can be recorded and may tarnish your reputation and jeopardize your employment status, particularly for civil servants or those in strict corporate sectors. However, retaining a Syarie Lawyer from the very beginning can help you minimize the risk of a conviction.
